Thursday.<\/p>\n<p>On Thursday, the U.S. Supreme Court sought to address a question the justices have wrestled with at different times in different contexts in recent years: Frustrations with nationwide, or \u201cuniversal\u201d injunctions.<\/p>\n<p>And yet, after <a href=\"https:\/\/www.supremecourt.gov\/oral_arguments\/argument_transcripts\/2024\/24a884_2c83.pdf\" target=\"_blank\">more than two hours of arguments<\/a> over the nationwide scope of injunctions blocking implementation and enforcement of President Donald Trump\u2019s executive order ending birthright citizenship, the court seemed more aligned on the unconstitutionality of Trump\u2019s order \u2014 and in agreement with all of the lower courts to consider the question \u2014 than on any solution about how to deal with nationwide injunctions.<\/p>\n<p>\u201cLet\u2019s just assume you\u2019re dead wrong\u201c about the order\u2019s constitutionality, Justice Elena Kagan told Solicitor General John Sauer. \u201cDoes every single person that is affected by this EO have to bring their own suit? Are there alternatives? How long does it take?\u201c<br \/>\n&#8230;<br \/>\nFirst, the nationwide injunctions being challenged by the Trump administration here are the injunctions blocking something that the Supreme Court has previously said is unconstitutional.<br \/>\n&#8230;<br \/>\nSecond, the Trump administration doesn\u2019t only argue that nationwide injunctions should be scaled back or limited. His main gig is serving as secretary of state, but in February he was <a href=\"https:\/\/www.state.gov\/secretary-marco-rubio-appointed-as-acting-administrator-for-the-united-states-agency-for-international-development-usaid\/\" target=\"_blank\">appointed<\/a> acting administrator of the U.S. Agency for International Development. <a href=\"https:\/\/www.foxnews.com\/politics\/rubio-named-acting-director-another-us-government-agency-report\" target=\"_blank\">Days later<\/a>, he also became the acting archivist of the United States.
